Terms of use

This page is a draft. A lawyer is still checking it, and the details in [square brackets] are still to be filled in.

Last updated: [EFFECTIVE DATE]

These terms are the agreement between you and VOICEVUI SRL (registered in Romania, company number [COMPANY NUMBER], address Aleea Zanelor 18, Bl. B, Sc. B, Ap 28, Bucharest, Romania). "We", "us" and "Puffin" mean VOICEVUI SRL. "You" means the person using Puffin.

We've kept them as short and plain as we can. Please read them. If anything's unclear, email hello@puffinhq.com.

The short version

  • Puffin is for adults (18+) running a business, like freelancers and makers.
  • There's a Free plan, and Pro at US$15 a month or US$150 a year, including any VAT. No trial.
  • Pro isn't on sale yet. Once it is, it renews until you cancel. You cancel from one page, and Pro keeps working to the end of the time you've paid for.
  • Your records belong to you. Export them any time.
  • When we add card payments, they'll go through your own Stripe account. Stripe charges its own fee. Puffin takes no cut.
  • Puffin works inside ChatGPT, but it's an independent app. OpenAI doesn't make it.
  • Be fair: no spam, no fake invoices, nothing illegal.

1. Who can use Puffin

You can use Puffin if:

  • you’re 18 or over; and
  • you use it for your business, like freelancing, selling things you make, or a small company. Sole traders are welcome.

If you use Puffin for a company, you’re agreeing to these terms for that company, and you confirm you’re allowed to.

You also need a ChatGPT account, and must follow OpenAI’s rules for using ChatGPT.

2. Your account and the email code

  • You connect Puffin inside ChatGPT with your name and email address. We email you a 6-digit code. There are no passwords.
  • One email address is one Puffin account.
  • Keep your email account safe. Anyone who can read your email (or your backup email) could get a code. We suggest adding a backup email in Puffin, in case you ever lose your main one.
  • We email you when someone signs in to your account from a new browser. If it wasn’t you, tell us right away at hello@puffinhq.com.
  • Please give us your real details, and keep them up to date.
  • You’re responsible for what happens in your account, unless it’s our fault.

3. Free and Pro

  • Free costs nothing and doesn’t run out. It has limits, like the number of active clients. You can archive a client to free up a space. Archived clients keep their history.
  • Pro removes those limits and adds extra tools, like sending invoice reminders to your clients for you.
  • What’s in each plan is shown on our website and inside Puffin before you upgrade.
  • If we ever make the Free plan smaller, we’ll email you at least 30 days before. We’ll never delete your records because of a plan change.

4. Paying for Pro, renewing and canceling

We haven’t started selling Pro yet. When we do, this section applies.

Price. Pro is US$15 a month or US$150 a year. The price includes any VAT or sales tax. We charge in US dollars. Your bank may add a fee for paying in another currency.

How you pay. Payments are handled by Stripe. You pay at the start of each month or year.

Renewing. Pro renews automatically at the end of each month or year, until you cancel. For yearly plans, we email you 7 days before each renewal, with the date and the price.

Canceling. Cancel any time from one page: ask Puffin in ChatGPT to “cancel Pro” and you’ll get a link to that page, with one button. You don’t need to call us, write to us or give a reason.

After you cancel. Pro keeps working until the end of the month or year you’ve paid for. Then your account moves to Free. Nothing is deleted. If you have more active clients than Free allows, they all stay. You just can’t add new ones until you archive some, or come back to Pro.

Refunds. We don’t give refunds for part of a month or year you’ve already paid for, except:

  • in your first 14 days, if you’re a consumer in the UK or EU (see section 5);
  • if Puffin didn’t work as promised because of us, for example a long breakdown; or
  • where the law says we must.

Your legal rights as a consumer aren’t affected by anything here.

Failed payments. If a payment doesn’t go through, we email you and try again for up to 7 days. If it still doesn’t work, your account moves to Free. Nothing is deleted.

Price changes. If we change the Pro price, we’ll email you at least 30 days before it affects you. The new price starts from your next renewal after that. If you don’t want it, cancel before then and you won’t pay the new price.

5. Changing your mind: 14 days (UK and EU)

If you live in the UK or the EU and you’re buying Pro as a consumer (not for a business), you have the right to change your mind within 14 days of buying.

  • To do this, use the “Withdraw from Pro” link on your billing page. It’s there for your first 14 days. You can also email hello@puffinhq.com with your account email and the words “I withdraw from my Pro plan”.
  • We’ll refund what you paid, in full, within 14 days of you telling us.
  • Your account moves to Free. Nothing is deleted.

Even if you’re buying for your business, we’re happy to give the same 14-day refund. Just ask.

6. Your records belong to you

  • Everything you put into Puffin (your clients, quotes, invoices, stock and the rest) belongs to you. We call this “your content”.
  • You give us permission to store, copy and use your content only to run Puffin for you. For example, to show it to you in ChatGPT, turn a quote into a PDF, or send an invoice to your client. This permission ends when you delete your content or your account, except for backups that are deleted on a timetable (see our Privacy policy).
  • We don’t sell your content. We don’t use it for ads. We don’t use it to train AI.
  • You’re responsible for your content being accurate and legal. Puffin helps with quotes, invoices and tax lines, but it isn’t an accountant or a lawyer. Check that your quotes and invoices meet the rules where you are.
  • Puffin itself, its name, the puffin logo, the app and the website belong to us. You can’t copy them without asking.
  • If you send us ideas or feedback, we can use them to improve Puffin without paying you. Thank you.

7. Downloading your data

  • You can download all your records any time, on any plan, including after you cancel Pro.
  • Ask Puffin in ChatGPT to “export my data”. You’ll get a link that works for 15 minutes. It downloads a ZIP file of spreadsheets, plus your files, like your logo and PDFs.
  • Once you delete your account, your records are gone. So please download them first if you want to keep them. The delete page has a “Download my data first” button.

8. Fair use: what you must not do

Please don’t use Puffin to:

  • break the law, or help someone else break it;
  • send fake, misleading or made-up quotes or invoices, or ask for money you aren’t owed;
  • send spam, or email people who haven’t dealt with you;
  • harass, threaten or bully anyone, including clients who owe you money;
  • store information you have no right to hold;
  • pretend to be someone else, or another business;
  • upload viruses or harmful code;
  • try to get into accounts or systems that aren’t yours, or test Puffin’s security without our written OK;
  • overload Puffin, copy it, or use robots to scrape it; or
  • resell Puffin, or build a copy of it.

If you do, we may pause or close your account (see section 14).

9. Your clients' details (data processing)

When you put details about your clients (or, once we add Etsy, your Etsy buyers) into Puffin, you are the controller of that information and we are your processor. This section is our agreement about it. It’s what UK and EU data protection law asks for.

What we handle, and why.

  • Whose details: your clients and their contact people, and your Etsy buyers if we add the Etsy connection and you connect your shop.
  • What details: names, company names, email addresses, notes you write, quotes, invoices, payments and reminders, and when clients open or answer a quote or invoice.
  • What we do with them: store them, show them to you, and send quotes, invoices and reminders when you ask. On Pro, we also send invoice reminders on a schedule, unless you turn that off for a client.
  • For how long: while you use Puffin. When you delete your account, we delete them (backups follow within 30 days).

Your promises.

  • You have a fair, legal reason to hold your clients’ details in Puffin and to email them.
  • You tell your clients what you need to, for example in your own privacy notice.

Our promises.

  • We only use your clients’ details to do what you ask through Puffin, unless the law makes us do something else. If it does, we’ll tell you, unless the law stops us.
  • Anyone who works on Puffin must keep the details confidential.
  • We keep the details safe (see “Keeping information safe” in our Privacy policy).
  • We only use the companies listed in our Privacy policy to help us. They must follow the same rules. If we add or change one, we’ll update that list and email you at least 30 days before. If you don’t agree, you can leave Puffin and take your data with you.
  • If a client asks you about their rights, we’ll help you answer. You can already find, change, export and delete their details yourself.
  • If there’s a security problem that affects your clients’ details, we’ll tell you without delay, and within 48 hours of finding out at the latest, with what we know.
  • We’ll help you with anything else the law asks of you about this information, where it’s reasonable, such as a risk assessment.
  • When you delete your account, we delete your clients’ details.
  • If you need to check we’re keeping these promises, ask us and we’ll give you the information you need.
  • If details go outside the UK or EU, we protect them as set out in our Privacy policy.

10. Card payments through Stripe

We haven’t added card payments yet. When we do, this is how they’ll work.

  • If you want clients to pay your invoices by card, you connect your own Stripe account to Puffin. Stripe is a separate payment company.
  • Stripe’s own terms apply between you and Stripe, including the Stripe Connected Account Agreement. Stripe decides whether to accept you, and when to pay money out to your bank.
  • Stripe charges its own fee on each payment. You can see Stripe’s prices at stripe.com/pricing.
  • Puffin takes no cut of your card payments. Not a percentage, not a fixed fee. The money goes from your client to your Stripe account.
  • Any arguments about a payment, like a refund or a chargeback, are between you, your client and Stripe. We’ll help where we can.
  • We never see or store full card numbers.
  • Pro plans are also paid through Stripe (see section 4).

11. ChatGPT and OpenAI

  • Puffin works inside ChatGPT. ChatGPT is a trademark of OpenAI. Puffin is an independent app and is not made, endorsed or certified by OpenAI.
  • You need a ChatGPT account, and OpenAI’s terms and privacy policy apply to your use of ChatGPT.
  • What you type in ChatGPT, and what Puffin sends back, passes through ChatGPT. Our Privacy policy explains this.
  • ChatGPT is an AI and can get things wrong. That’s why Puffin shows you a card before anything is sent (Pro’s automatic invoice reminders are the one exception). Please check everything before you send it.
  • If ChatGPT is down or changes, parts of Puffin may stop working for a while. Pages your clients open from an email (like a quote or invoice) are run by Puffin, so they keep working.
  • ChatGPT plugins may not be offered in every country or on every type of ChatGPT account. That’s up to OpenAI.

12. Keeping Puffin running, and changes

  • We try to keep Puffin running all the time, but we can’t promise it will never stop, be slow or have mistakes. Sometimes we’ll need to pause it to fix or improve things. We’ll try to do that at quiet times.
  • We keep improving Puffin, so features may change. If we remove something important that you pay for, we’ll email you at least 30 days before. If you’re on Pro and the change makes Puffin worse for you, you can cancel and we’ll refund the unused part of your plan.

13. Our responsibility to you

  • Nothing in these terms limits our responsibility for death or personal injury caused by our carelessness, for fraud, or for anything else the law doesn’t let us limit.
  • If you’re a consumer, you have legal rights that these terms can’t take away. For example, in the UK, services must be provided with reasonable care and skill.
  • Puffin is a tool to help you run your business. It isn’t an accountant, tax adviser or lawyer. You’re responsible for the quotes, invoices and tax you send.
  • We’re not responsible for losses we couldn’t have reasonably expected, or for loss of business profits, income or chances. This applies to business users.
  • We’re not responsible for what other companies do, including OpenAI, Stripe, Cloudflare and Etsy, or for problems caused by things outside our control.
  • If we’re responsible for a loss to your business, the most we’ll pay in total is the larger of: what you paid us for Pro in the 12 months before it happened, or US$100.
  • The Free plan is given “as is”, for free.

14. Ending your use of Puffin

You can leave any time.

  • To stop Pro, see section 4.
  • To delete your account and everything in it, ask Puffin in ChatGPT to “delete my account”. You’ll get one page with one button. Deleting also stops any Pro plan, and your clients can no longer open links you sent them.

When we may pause or close your account.

  • If you seriously or repeatedly break these terms, or we must by law, we may pause or close your account.
  • We’ll tell you why and, where it’s fair and safe, give you a chance to fix it first.
  • Unless it would break the law or put people at risk, we’ll give you at least 30 days to download your data before we delete anything.
  • If we close your account and it isn’t because you broke these terms, we’ll refund the unused part of any Pro plan.

If Puffin ever shuts down. We’ll email you at least 60 days before, give you time to download your data, and refund the unused part of any Pro plan.

Sections 6, 13, 15 and 17 still apply after your account ends.

15. Which law applies

These terms are governed by [GOVERNING LAW]. Any disagreement goes to the courts of [GOVERNING LAW], unless the law says otherwise.

If you’re a consumer, you keep the protection of the laws of the country where you live, and you can bring a claim in your local courts.

Please talk to us first. Most problems can be fixed with an email.

16. Changes to these terms

If we change these terms in a way that matters, we’ll email you at least 30 days before the change starts and explain it in plain words. If you don’t agree, you can cancel or delete your account before then. For small changes, like fixing a typo, we’ll update the date at the top.

If any part of these terms turns out not to be legal, the rest still applies.
